Paragraph 11 - Property Inspections

There are 9 different property inspections for the Buyer to choose to elect or waive. Each of these inspections, described in the Agreement, has detailed instruction in the 85 lines from line 215 to 300 and two pages of Notices on the back of page 4 and 5. Each inspection is at the Buyers expense and performed by “professional contractors, home inspectors, engineers and other properly licensed professionals.”

This is your only opportunity to evaluate the true condition of the Property. If you elect to perform an inspection, then you have that option available. If you waive any inspection, then you do not have recourse with the Seller. OF COURSE there is an exception, if a lender or insurer requires an inspection and the results are not satisfactory then you may terminate the Agreement if mortgage or insurance is denied.

Buyer Responsibility

Buyer has the responsibility to meet the deadlines as well as:

  • Provide copies of the reports to Buyer’s agent and, if requested, the Seller
  • Accurately describe corrective action you want the Seller to perform
  • Always take the initiative
  • Make a pre-settlement walk-through inspection of the Property to assure the Property is in the same condition when inspected allowing fair wear and tear, and to check the corrective action the Seller promised is satisfactorily completed

Seller Responsibility

Seller has responsibility to:

  • Provide access
  • Have utilities and heating on for all inspections and appraisals
  • Locate and provide access to the on-site water
  • Locate, provide access, and empty the individual on-lot sewage disposal system
  • Restore the Property to same condition as the date of executing the Agreement allowing for fair wear and tear

Weather Prevented Property Inspections

These are some of the problems all parties have to work with:

  • Inspect pool equipment in freezing weather
  • Inspect the roof when covered with snow or during inclement weather
  • Inspect the septic drain field when the ground is frozen
  • Inspect the A/C in cold weather
  • Inspect some heating systems in warm or hot weather
