Part 4 - Additional Stipulations
The additional stipulations in paragraphs 18 to 26 that include lines 481 to 582, with one exception, are statements that both the Buyer and Seller must adhere. Paragraph 27, Special Clauses, lists PAR forms that will become part of the agreement if checked. Even with these legal sounding terms, Realtors® still are not lawyers and do not offer any legal advise.
NOTE: When Realtors® change words, phrases or sentences in the printed portion of the agreement is an example of how an agent starts to act as a lawyer. Always ask if the agent is a lawyer if the “boiler plate” is changed. When I receive an agreement with word and phrases crossed out, I recommend the seller seek advice of a lawyer. Even if the seller does not seek legal counsel I request he sign a letter stating I offered that advice.
